Nevada Foreclosure Laws

Nevada Foreclosure Law has the Deed of Trust and mortgage as a primary security instrument and takes place both by Judicial as well as Non-Judicial foreclosure procedure. In Nevada it takes about 120 days for the process of foreclosure.

NV Foreclosure Law

Judicial Foreclosure: Judicial Foreclosure occurs with the orders from the court as the deed of trust is without the Power of Sale. The court gives time period to the borrower for the payment but if not paid then order to carry on foreclosure auctions is given. In judicial foreclosure process there exists a redemption period but a borrower can redeem after a year of foreclosure.

Non-Judicial Foreclosure: Non-Judicial Foreclosure has the power of sale in which borrower pre-authorizes the mortgage lender to conduct foreclosure in case of any default. In Nevada most of the foreclosure processes take place by this method. Now if date, time, place and procedure is also mentioned then it will take place according to that otherwise "Power of Sale Foreclosure Guidelines" are followed. The procedure for this is:
  • Notice of sale is recorded in the office of county where property is located according to the Nevada foreclosure law
  • Same notice is then mailed to the borrower at the last known address. The mail should be certified and ask for the return receipt.
  • The defaulter can pay the amount within 15-35 days of the notice to stop the process of foreclosure in NV
  • Notice of sale is also published for three weeks in the newspaper, once in every week
  • Before 20 days of the auction, the notice of sale is posted at the three public places in the county
  • The auction of the property takes place at the courthouse
  • In case the foreclosure auction is postponed then at the place and time of the sale, public announcement regarding delay in the sale is done
Further according to the Nevada foreclosure law there is no right to redeem the property if sold by non-judicial foreclosure process.
