Texas Real Estate License Act

Texas Real Estate License Act covers Real Estate Brokers and Salesperson and was passed in 1939 by the Texas Legislature. Inspectors and brokers are covered in different chapters of the act. These are:
  • Chapter 1101 for Brokers and Real Estate Salesperson
  • Chapter 1102 for Inspectors

TREC and the Real Estate License Act



The Chapter 1101, Texas Occupations Code has the Real Estate License Act and covers the licensing requirements. The act has also led to the formulation of the Texas Real Estate Commission, which is the licensing governing body. The Commission is also the rule making authority that makes the rules for efficient working. The Texas Real Estate Commission works according to the Texas Sunset Act of Chapter 325,Government Code. This TX Real Estate License Act was amended on September 1, 2007

Further according to the TX Real Estate License Act, the Commission consists of nine real estate commissioner who are appointed by the governor in consultation with senate. Issuing license, real estate exam, education requirements, reviewing license and revoking or denying for the license come under the responsibility of commission. Along with real estate salesperson and broker, licenses for real estate inspectors, residential service companies and residential rental locators are also covered by the Commission.

Texas Real Estate Act defines Licensing Requirements



Texas Real Estate License Act defines the real estate brokers and salesperson. It is according to this act that the real estate courses, Commission, training and other such requirements are prescribed. The fee for the brokers' as well as salespersons' license is also defined by the Real Estate License Act Texas. It is the section 1101.152 that sets the fee and along with this additional fee of $17.50 for salesperson's license and $20 for broker's license is charged.

For every real estate professional it is mandatory to clear the Texas Real Estate License Act exam in order to obtain the license. Any unlicensed person, according to the Texas Real Estate License Act is subjected to the penalty. The penalty may include license suspension, revocation and fine. So all the legalities must be understood before starting this profession.
